SC refuses to hear Shaheen Bagh, says victims come, not political parties


Bulldozer in Shaheen Bagh: The Supreme Court has refused to hear the petition filed against the removal of encroachment from Shaheen Bagh. On Monday, the Supreme Court reprimanded and also asked why political parties had approached the court instead of the victims in this case.

The court said they had not stopped the ongoing campaigns against encroachment across the country during the hearing. Also, the matter in Shaheen Bagh is not related to residential houses but is related to the evacuation of the road.

After this, the CPIM party also withdrew its petition. Let us inform you that the Communist Party of India, Marxist (CPIM), had filed a petition in the Supreme Court to stop the action being taken by the MCD against the illegal construction of South Delhi.


The Supreme Court asked – is there no victim?

A hearing on the action of removal of encroachment in South MCD was held in the Supreme Court this afternoon. The court asked why the CPIM party was filing a petition in this matter. The court said it is understandable if any aggrieved party comes to us. Is no one suffering?

On this, senior advocate P Surendranath said that there is also a petition from the association of street vendors. Further, Justice Rao said you should have gone to the High Court. At the same time, it was also noted that if the street vendors are also breaking the rules, then they will also be removed.

The court said that we intervened in Jahangirpuri because buildings were being demolished. Street vendors sell goods on the road. If the shops are damaged, they should have come to the court. Why did the street vendors come?


The court asked the petitioner what had been broken in South Delhi? On this, Advocate Surendranath said that the shops are being removed.

Further, the court asked the government whether the notice was not given before taking action under the rule? Solicitor General Tushar Mehta said that it is not so; no illegal construction is demolished without warning.

Tushar Mehta said that he had the notice of the concerned officer. It was written that the work had been done according to the rules to remove the encroachment from the footpath, and notice is not required in it.


It was said that some temporary constructions had to be removed. But the street vendors themselves had removed a lot of encroachment. The court was told that no residential house had been demolished in Shaheen Bagh on behalf of the government.

Further, the counsel for CPIM said that the court itself had stayed the encroachment removal action. The Supreme Court said that we had not stopped every ongoing action against encroachment in the country. If residential houses are demolished, we will intervene. But here, the matter is about removing the encroachment from the road.

Bulldozer returned from Shaheen Bagh.

According to South MCD, today, the encroachment in Shaheen Bagh was to be removed. The bulldozer reached there at 11 am, but he had to return colourless. There was a massive protest against the action of MCD in Shaheen Bagh. The MCD only removed the iron rods standing in front of a house used for shattering work. Local people said that they had to be removed after the renovation anyway.
